21st SW Monthly Docket - Sept 2016 Published Oct. 4, 2016 21st Space Wing Public Affairs PETERSON AIR FORCE BASE, Colo. -- During September 2016, the following military justice and administrative actions occurred within the 21st Space Wing. The actions listed below are tools for commanders to use in maintaining good order and discipline in the unit, rehabilitating airmen, and punishing misconduct. Nonjudicial Punishments (Article 15): A member’s commander found that an airman was derelict in his duties, in violation of Article 92, Uniform Code of Military Justice, and made a false official statement, in violation of Article 107, UCMJ. As punishment, the commander reduced the Airman in grade to E-1 and reprimanded the member. A member’s commander found that a senior airman was AWOL, in violation of Article 86, UCMJ, and made a false official statement, in violation of Article 107, UCMJ. As punishment, the commander reduced the Airman in grade to E-3, imposed 14 days of extra duty and reprimanded the member. A member’s commander found that a staff sergeant negligently destroyed military property, in violation of Article 108, UCMJ. As punishment, the commander reduced the Airman in grade to E-4 and reprimanded the member. General Courts-Martial: A military judge found a staff sergeant guilty of a charge and its specification of attempted wrongful distribution of cocaine, in violation of Article 80, UCMJ, a charge and its specification of reckless driving, in violation of Article 111, UCMJ, and a charge and two specifications of wrongful use of cocaine, in violation of Article 112a, UCMJ. A panel of officers sentenced the staff sergeant to a bad conduct discharge and 3 months confinement. A military judge found a staff sergeant guilty of a charge and its specification of violation of a lawful general regulation, in violation of Article 92, UCMJ, a charge and eight specifications of violation of a lawful general regulation, in violation of Article 92, UCMJ, a charge and its specification of forgery, in violation of Article 123, UCMJ, and a charge and its specification of obstructing justice, in violation of Article 134, UCMJ. The military judge sentenced the staff sergeant to a bad conduct discharge, 18 months confinement, total forfeitures of all pay and allowances, and reduction in grade to E-1. A military judge found a master sergeant guilty of a charge and its specification of dereliction of duty, in violation of Article 92, UCMJ, a charge and two specifications of larceny, military property, of a value of more than $500.00, in violation of Article 121, UCMJ, and a charge and four specifications of making a false official statement, in violation of Article 107, UCMJ. The military judge found the master sergeant not guilty of one specification of larceny. The military judge sentenced the master sergeant to a bad conduct discharge, to be reduced in grade to E-4, to pay a $30,000 fine, to 8 months confinement if the fine is not paid, and to be reprimanded . Special Court-Martial: A military judge found an airman guilty of a charge and one specification of wrongful use of marijuana and one specification of wrongful use of methamphetamine, both in violation of Article 112a, UCMJ. A panel of officers found the airman not guilty of a charge and its specification of making a false official statement, in violation of Article 107, UCMJ, and a charge and one specification of wrongful use of marijuana, in violation of Article 112a. The panel of officers sentenced the Airman to 8 months confinement, forfeiture of $1,044 per month for 8 months, and reduction in grade to E-1. Administrative Discharges: A staff sergeant was involuntarily discharged for Unsatisfactory Performance for failing to meet minimum fitness standards. The Airman’s service was categorized as Honorable.
