Fireworks safety, laws important to remember on Independence Day Published June 26, 2008 By Burke Ferrin 21st Civil Engineer Squadron Fire Emergency Services PETERSON AIR FORCE BASE, Colo. -- Fireworks are traditionally a major part of our Independence Day celebrations. The following information is intended to help clarify which fireworks are legal and which are not. It is illegal to use, sell or possess any fireworks not classified below as "permissible." Most common fireworks are legal in Colorado, with the exception of those items that fly through the air, explode or shoot flaming balls. The following categories of fireworks are illegal in El Paso County: · Bottle rockets · Firecrackers of any type · Mortars · Roman candles The following categories of fireworks are permissible in El Paso County: · Fountains · Ground spinners · Smoke Bombs · Sparklers · Small cars or tanks with pyrotechnics Fireworks should not be confused with "trick noise makers." Trick noise makers are not classified as fireworks and are not prohibited by the fireworks statutes. Trick noise makers are frequently sold at fireworks stands, but are also sold at many grocery stores, including inside our local municipalities. These items will bear a label that states they are trick noise makers. They function by throwing them on the ground or by pulling a string. Trick noise makers include: · Snaps (small paper wads that are thrown on the ground) · Champagne poppers (pull string and they launch colored paper) · Pull string poppers (small 2" paper tube with a string from each end) Both unlawful fireworks and permissible fireworks are prohibited in the incorporated cities of Colorado Springs, Monument, Fountain, Manitou Springs, and all of Teller County. All fireworks with a fuse and/or requiring a flame for ignition are illegal in Colorado Springs city limits. These kinds of fireworks are also prohibited on Peterson Air Force Base. Only novelty items (snappers and poppers) are allowed. Under Colorado state law, a fire started by fireworks that threatens or damages property is a crime of arson. Possession, use and/or the sale of fireworks violates City of Colorado Springs ordinance 9.7.302 and is subject to a fine of up to $500 and/or up to 90 days in jail. Professional public and private firework displays are regulated, permitted and approved, on an individual basis, by the Office of the Fire Marshal. Fireworks in general are forbidden on Peterson.
